Terms & Conditions
Last updated: 20 July 2026
These terms and conditions ('Terms') govern your use of www.susanmacnicol.co.uk (the 'Website'), operated by Susan Mac Nicol ('I', 'me', 'my'). By accessing or using the Website, you agree to be bound by these Terms. If you do not agree, please do not use the Website.
1. Who I Am
The Website is operated by Susan Mac Nicol, a self-published and independently operating author based in the United Kingdom.
Contact: susan@susanmacnicol.co.uk
2. Use of the Website
The Website provides information about my books, series, and related content, including blog posts, news, and promotional material. You may browse the Website for personal, non-commercial use.
You agree not to:
• Use the Website in any way that is unlawful, fraudulent, or harmful.
• Attempt to gain unauthorised access to the Website, its servers, or any connected database.
• Introduce viruses, malware, or other harmful material to the Website.
• Scrape, copy, or reproduce content from the Website for commercial purposes without permission.
• Impersonate any person or misrepresent your affiliation with any person or entity.
3. Intellectual Property
Unless otherwise stated, all content on the Website — including text, book excerpts, cover artwork, graphics, logos, and design elements — is my property or is used under licence, and is protected by UK and international copyright, trade mark, and other intellectual property laws.
You may view, download, and print pages from the Website for personal, non-commercial reference only. You must not reproduce, republish, distribute, or exploit any content for commercial purposes without my prior written consent.
Book covers, titles, character names, and series names (including, without limitation, the Men of London, Monarchs of Magic, Fetish Alley, Double Alchemy, and Starlight series) remain my intellectual property. All rights reserved.
4. Purchases and Third-Party Retailers
Books referenced on the Website are generally sold via third-party retailers and platforms (for example, Amazon, other online booksellers, and Books2Read). Any purchase you make through a third-party retailer is subject to that retailer's own terms and conditions, privacy policy, pricing, and returns process — I am not a party to that transaction.
Where the Website contains affiliate links (for example, Amazon Associates links), I may earn a commission on qualifying purchases made through those links, at no extra cost to you. This does not affect the price you pay.
Pre-order, release date, and pricing information is provided in good faith but may change without notice and is ultimately governed by the relevant retailer.
5. Links to Other Websites
The Website may contain links to third-party websites (retailers, social media platforms, Canva-hosted content, or other author or publisher sites) for your convenience. I do not control and am not responsible for the content, accuracy, or privacy practices of any linked third-party website. Links do not imply endorsement.
6. Comments, Reviews, and User Content
If the Website allows comments, reviews, newsletter sign-ups, or other user-submitted content, you agree that any content you submit:
• Will be lawful, accurate, and not defamatory, obscene, or infringing of any third party's rights.
• May be moderated, edited, or removed at my discretion.
• Grants me a non-exclusive, royalty-free licence to display and use that content on the Website in connection with its ordinary purpose (for example, displaying a review).
7. Age Restriction and Content Notice
Some of my books contain mature themes, explicit content, and adult language intended for readers aged 18 and over. Blurbs, excerpts, and cover art displayed on the Website are presented with this in mind. The Website itself is intended for a general adult audience; if you are under 18, please browse with a parent or guardian's guidance.
8. Privacy and Data Protection (UK GDPR)
I take your privacy seriously. This section summarises how I handle personal data in compliance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Full detail is set out in my separate Privacy Policy, available at https://susanmacnicol.co.uk/privacy-policy which forms part of these Terms.
8.1 What data I collect
Depending on how you interact with the Website, I may collect:
• Contact details you provide voluntarily (for example, name and email address when subscribing to a newsletter or using a contact form).
• Technical data such as IP address, browser type, and device information, collected automatically via cookies or analytics tools.
• Correspondence you send me directly (for example, via email or a contact form).
8.2 Legal basis for processing
I process personal data under one or more of the following lawful bases:
• Consent — for example, when you opt in to a newsletter or mailing list.
• Legitimate interests — for example, to understand how the Website is used and to improve it, provided this does not override your rights.
• Contractual necessity — where relevant to fulfilling a request you have made (for example, responding to an enquiry).
8.3 How I use your data
Personal data is used only for the purpose it was collected — for example, sending newsletter updates you've opted into, responding to enquiries, or maintaining the security and functionality of the Website. I do not sell your personal data.
8.4 Cookies
The Website may use cookies and similar technologies to support functionality and, where applicable, analytics. Where cookies are not strictly necessary for the Website to function, I will ask for your consent in line with UK GDPR and the Privacy and Electronic Communications Regulations (PECR). You can control or disable cookies through your browser settings; more detail is in the Privacy and Cookie Policy at https://susanmacnicol.co.uk/privacy-policy
8.5 Third-party processors
Where I use third-party services to operate the Website or communicate with readers (for example, website hosting, email newsletter platforms, or analytics providers), those providers process data on my behalf and are required to handle it securely and in accordance with UK GDPR.
8.6 Data retention
Personal data is retained only for as long as necessary for the purpose it was collected — for example, for as long as you remain subscribed to a mailing list, or as required by law.
8.7 Your rights
Under UK GDPR, you have the right to:
• Access the personal data I hold about you.
• Request correction of inaccurate data.
• Request erasure of your data ('right to be forgotten'), where applicable.
• Object to or restrict certain processing.
• Withdraw consent at any time (for example, unsubscribing from a newsletter).
• Request data portability, where technically feasible.
• Lodge a complaint with the Information Commissioner's Office (ICO) at ico.org.uk if you believe your data has been mishandled.
To exercise any of these rights, contact me at susan@susanmacnicol.co.uk
8.8 International transfers
Where personal data is processed by a third-party provider based outside the UK, I will ensure an appropriate safeguard is in place (such as the UK's International Data Transfer Agreement or an adequacy decision) before that transfer takes place.
9. Disclaimer and Limitation of Liability
The Website and its content are provided 'as is' for general informational purposes. While I take reasonable care to keep information accurate and up to date (including release dates, pricing, and availability), I make no warranty that the Website will be error-free, uninterrupted, or entirely current.
To the fullest extent permitted by law, I exclude liability for any indirect, incidental, or consequential loss arising from your use of the Website. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded under UK law.
10. Indemnity
You agree to indemnify me against any claims, losses, or expenses arising from your breach of these Terms or your misuse of the Website.
11. Changes to These Terms
I may update these Terms from time to time to reflect changes in the law, the Website, or my business practices. The 'Last updated' date at the top of this page will indicate when changes were made. Continued use of the Website after changes are posted constitutes acceptance of the updated Terms.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales. Any disputes arising out of or in connection with these Terms or your use of the Website will be subject to the exclusive jurisdiction of the courts of England and Wales.
